Writs of Restitution received Monday through Thursday of any given week will be served by Friday of the same week. Writs received on Friday will carry over to the following week. Moves take place on the next Thursday, if necessary. A 48-hour notice is served on the tenant or if no one is available, the notice is posted. The fee for the service of the 48-hour notice is $60.00, which must be paid upon presentation of the Writ of Restitution. Checks must be made payable to the Racine County Sheriff.
If the tenant has not moved as requested, the landlord needs to schedule the eviction. In order to do this, a deposit for $400.00 must be received in the Records Bureau by 4:00 p.m. on Tuesday. Checks must be made payable to Eagle Movers. We will not accept cash for eviction deposits. If no deposit is received from the landlord by the deadline, the Writ of Restitution expires and is returned to the Clerk of Courts.
If the landlord is choosing to remove/store/dispose of property themselves, the eviction will be automatically scheduled at the time the Writ of Restitution is submitted.
Every Thursday, evictions begin at approximately 10:00 a.m. and are scheduled by location. Landlords will be called just prior to arrival if possible. Any cancellations for that day must be received by 8:30 a.m.
Fees for the Sheriff’s Office’s time at the eviction are billed separately. The rate is $46.16 per deputy per hour. There are two deputies present during every eviction.
Fees for storage or removal of property are due directly to Eagle Movers. A listing of their current rates is available upon request.
